This Privacy Policy governs your use of our wearable devices (“Device”), the iGPS website, www.igpsphoenixwatch.com (“Site”) and the iGPS App mobile application (“App”) (collectively “iGPS Services”) as made available to you by iGPS (“we”, “us” and “our”) and describes the data that we collect and how we use and disclose it. You must accept this Privacy Policy to create an account with us and activate your Device or otherwise use any aspect of the iGPS Services.

By visiting our Site or App, or by creating an account with us, you agree to the provisions of this Privacy Policy, incorporated into the Terms of Service. If you do not agree to this Privacy Policy, please exit the Site or App and do not create an account or activate your Device.

Modifications:

We may, at our sole discretion, revise this Privacy Policy from time to time. The most current version of the Privacy Policy will be made available to you on the Site and the App. If we make material changes to this Privacy Policy, we will notify you on the Site and the App prior to the effective date of the changes or otherwise notify you. By continuing to access or use the Services after those changes become effective, you agree to be bound by the revised Privacy Policy. If you do not agree to the revised Privacy Policy, please do not use the iGPS Services.

Notice to Parents and Guardians Regarding Access by Children:
The Services, through the geolocation and recording features on the Device, collect personal information from users under 13 years of age. As a result, we require you to confirm that you are the parent or legal guardian of the child registered to any Device and that we have your permission and consent to collect the information set forth below regarding and from your child. You may not activate the Device until you provide us this verifiable consent.

What We Collect and How We Use It:

When you set up an account or purchase something from the Site or the App, we collect the personal information you give us such as your name, cell phone number, address and email address. We may also collect your payment information through our third-party payment processor, as discussed below. We may collect information you voluntarily provide to us when you contact us through the Site or the App or sign up for email marketing. Furthermore, if you use location services featured with the iGPS Services, we will collect the geolocation data of the wearer of the Device. This information will only be used for the specific purpose for which it was disclosed.

When you browse the Site or the App, we also automatically collect non-personally identifiable information from you, such as your computer’s internet protocol (IP) address and cookies, as discussed in more detail below.

Cookies:

We use cookies to improve your experience and provide a better service. A “cookie” is a piece of data stored on the user’s hard drive, containing information about the user, such as areas on the Site or the App you visit or which products you click on for more information. We use cookies on the Site and the App, but none of them contain any information that could actually identify you as a person. Rather, cookies can help us provide you with information targeted to your interests. Cookies are stored on your hard drive, not on the Site or the App. Most cookies are “session cookies,” meaning that they are automatically deleted at the end of a session.

Most web browsers automatically accept cookies, but you can disable this function so that your browser will not accept cookies. Please be aware that disabling this function may impact your use and enjoyment of the iGPS Services.

IP Addresses:

We log IP addresses for systems administrative purposes. IP addresses are not used to track a user’s session. This information may be used to help us determine how often different areas of the Site or the App are visited. We do not link IP addresses to any information that is personally identifiable.

Analytics:

We use Google Analytics to collect information about your use of the Site and the App. This information consists of information that your browser automatically sends to Google, such as the web address of the page that you visit and your IP address. Google may also set cookies or read preexisting cookies. This information is stored on Google’s servers. Google uses this information to provide us with reports about traffic and your visit to the Site and the App. We will use this data to improve the Site and the App structure and content.

E-mail Newsletters:

The Site and the App allow you to receive emails about the iGPS Services. You may elect to join our email list when you visit the Site and the App, or we may automatically add you to that list when you make a purchase online through the Site or the App or otherwise use the Services. We may also ask you to identify departments or areas of specific interest to you, so we may better tailor our emails to match your preferences.

If you choose to receive emails from us, we will share your email information with our third-party email provider only for the purposes of sending those emails.

Disclosure:

We do not sell, rent or loan any of your personally identifiable information to any third party. We may use and share information with those persons and third-party entities specifically involved in the processing of your payment or your use of the Services as well as those third parties that we have engaged to provide us services to make the Device and iGPS Services available to you, such as our telecom provider, and our hosting provider. In addition, we may use and share aggregated information that does not uniquely identify you when it enables us to improve and enrich the Services. In addition, we reserve the right to use and share your information in the event we believe doing so is necessary to operate the iGPS Services or where such disclosure may be required by law, or to protect our rights or the rights of others.

If you use the Device we may collect your geolocation data and share this information with individuals designated by you. These individuals will be able to see location information from the Device and will be able to hear what is happening around your Device. This listening feature will be functional without notice to the wearer. If at any time you wish to disable this feature or remove an individual from the list of individuals with the ability to track the wearer’s location, you may do so by following the instructions provided on the Site and the App.

Third Party Websites:

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions

For these providers, we recommend that you read their privacy policy so you can understand the policy of which your personal information will be managed by these providers.

In particular, remember that certain providers may be located in or have facilities that are located in a different jurisdiction than either you or us. So, if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

Once you leave the Site or the App or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

When you click on links they may direct you away from the Site or the App. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.

Security:

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with an AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

Access by Minors:

By using the Services, you represent that you are at least 18 years of age and the parent or legal guardian of the child registered to the Device, and that you have given us your consent to allow any of your minor dependents to use the Services.

Do Not Track:

We do not currently recognize any “do not track” signals. We currently do not participate in any ad networks that tracks users over different websites.
